Terms and Conditions of Sale
General conditions
The following General Conditions of Sale govern the offer and sale, together with the Conditions of Use and the Privacy Policy, of products purchased on the website www.ldilinda.com (hereinafter the Site).
These General Conditions of Sale are drawn up in compliance with the legislative provisions of the Italian Civil Code, Legislative Decree no. 70/2014 on information society services and electronic commerce, the Consumer Code and which regulate the offer and sale of products through the website www.ldilinda.com
The products marketed on www.ldilinda.com are sold directly by Milor SpA, with registered office in Via dei Gracchi 35 Milan, registered in the Company Register of the Chamber of Commerce of Milan, CF / VAT no. 04362490155; (hereinafter for brevity referred to as the Seller).
Scope of application
The General Conditions of Sale apply to and regulate all sales contracts concluded through the Seller's Website, as identified above.
The General Conditions of Sale may undergo changes and each User is required to consult them before proceeding with each purchase. It is the User's responsibility to check the General Conditions of Sale before submitting the order.
The General Conditions of Sale apply regardless of the nationality of the User, provided that the delivery of the products must take place in one of the countries for which the Site provides the online sales service and that said country corresponds to the country of registration of the User.
Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.
The purchase of products on the Site is reserved exclusively to natural persons acting as consumers and who are over 18 years of age.
A consumer is any natural person who acts for purposes other than his or her commercial, entrepreneurial, artisanal or professional activity.
Conclusion of the contract
These General Conditions of Sale are an integral and essential part of the sales contract between the Seller and the User.
The electronic sending of the order by the User implies full knowledge and full acceptance of these General Conditions of Sale, Use and Privacy Policy. If the User does not agree with one or more terms contained in these General Conditions of Sale, he/she is asked to refrain from making purchases on the Site.
To proceed with the online purchase of one or more products, the User must provide the Seller, in compliance with the provisions on personal data protection, all the data necessary to allow the latter to execute the orders placed. To complete the purchase, the User must confirm the payment of the price of the products placed in the cart. Orders that do not record the corresponding transaction are automatically cancelled.
When the User places an order, he/she will receive an email containing confirmation of receipt of the order and a summary of the order: this communication will not, however, constitute automatic acceptance of the order.
The Seller reserves the right to refuse orders that are incomplete and incorrect or from users with whom there is an ongoing dispute regarding the payment of a previous order. In such cases, the User will receive an e-mail with a specifically motivated refusal of the order.
If the products presented on the Site are no longer available at the time of the last access to the Site or from the sending of the order, the Seller will be responsible for communicating to the User, within 5 days starting from the day following the one in which the order is transmitted, the unavailability of the ordered product. In the event of payment, the Seller will refund the price without being required to provide further compensation.
The order form contains a reference to these General Conditions of Sale and the Privacy Policy, as well as a summary of the essential characteristics of each product ordered and its price, the accepted payment methods and the delivery methods for the products purchased, shipping costs, the conditions for exercising the right of withdrawal and the methods and times for returning the products purchased.
The User can, at any time, monitor the status of his/her order by consulting the appropriate link/section or by accessing his/her personal area.
The languages of the contract are Italian and English
Product Features
The products offered for sale through the Site are exclusively top quality products. The Seller does not sell used, irregular or lower quality products than the corresponding standards offered on the market. The essential characteristics of the products are presented on www.ldilinda.com within each product sheet. The images and colours of the products offered for sale on www.ldilinda.com may however not correspond to the real ones due to the Internet browser and monitor used.
Product prices may be subject to change. Make sure you know the final sale price before submitting the relevant order form. All products are provided with an identification tag. We ask you not to remove the tag and the relative seal from the products purchased, of which they are an integral part.
The product catalogue may be updated and modified periodically, therefore the permanence of a product among those available online is not guaranteed.
Each product is presented by a descriptive sheet where all the essential characteristics are reported; the images and colors of the products offered for sale may not correspond exactly to the real ones due to the settings of the computer systems used by the User to view the Site. The images of the products must therefore be considered indicative and are subject to normal tolerances of use.
Selling prices
All sales prices of the products indicated on the Site include VAT, if applicable based on the country of shipment of the products and any other tax that may be applicable to the sale.
Product prices may be subject to updates and changes. The User is required to verify the final sale price before submitting the relevant order. The obvious material error reported in the price on the Site compared to the commonly known price of the chosen product entails the right of the Seller not to confirm the shipment and proceed with the immediate refund of the purchase value paid by the User without the latter being able to raise objections in this regard.
Value Voucher
Value vouchers are personalized codes that allow you to enjoy a discount on purchases made on www.ldilinda.com
Limitations on the use of the value voucher:
- The value voucher can be used only once, unless returned;
- The value voucher cannot be converted into cash in any way;
- It will not be possible to use multiple value vouchers in the same order;
- The value voucher will apply to only one item per order;
- The value voucher will only apply to items whose sales value exceeds the value of the voucher by at least 1 euro. It cannot be applied to items belonging to the Sample Sale or charity sales.
In case you wish to exercise the right of withdrawal provided for by art. 52 of the Consumer Code and return an item on which you have applied the value voucher, you will have to follow the standard return procedure available in the section Returns. Once your return has been accepted, the related code will be reactivated with its original value. The difference in expenditure that you incurred for the purchase of the item will be credited back to you according to the methods and terms established for the normal refund procedure.
Value vouchers may not be available at the time of purchase, consequently the user must verify the activation of the service prior to the order.
Payment Methods
To pay the price of the products and the related shipping and delivery costs, if applicable, the User may follow one of the methods indicated in the order form.
In case of payment by credit card, the payment procedure will be carried out via a secure connection directly linked to the banking institution that owns the online payment service, to which third parties cannot have access. In particular, the financial information (e.g. credit/debit card number, expiration date) will be forwarded via an encrypted protocol, which provides the related remote electronic payment services, without third parties having access to it. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of fraud on www.ldilinda.com . The price for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be charged to your current account at the time of shipment of the purchased products, without prejudice to the User's right to have the amount re-credited in the event of non-fulfilment by the Seller or failure to execute the contract for any reason.
The User is solely responsible for the data entered and therefore guarantees to use only credit/debit cards of which he has legitimate availability.
Delivery Methods
The products are delivered, via contracted couriers, directly to the User at the shipping address specified in the order. By filling in the personal data sheet in the order conclusion procedure necessary to activate the process for the execution of this contract and further communications, the User authorizes the Seller to communicate the personal data to the trusted couriers and/or forwarders used for the delivery of the purchased products in order to allow the procedures necessary for their delivery.
The Seller will do its best to process the order sent within 2 working days and in any case no later than 30 days from the day following the day on which the User sent the order. Delivery times include only working days and do not include holidays.
The Site allows you to request delivery of the products ordered to an address other than the User's own, provided that it is included in the country of shipment of the order; in any case, it is the User's responsibility to indicate all the references necessary for the successful delivery. It is never possible to collect the products purchased through the Site directly from the Seller's warehouse.
The costs and types of shipping provided may vary depending on the country and shipping methods chosen by the User. Said costs and any additional costs are the responsibility of the User. The relative amount will be expressly and separately indicated in the order summary, before the User proceeds to transmit the order, as well as in the order confirmation email.
The delivery procedure provides that, in the event of the recipient's absence when the courier arrives, the person in charge will leave a notice, in order to subsequently complete the shipment, which will indicate the contact details to contact to arrange the second delivery. In the event of failure to agree on the second delivery, the package will remain in storage at the courier's warehouse and it will be the User's responsibility to arrange for collection. In the event of failure to collect within 4 days, the package will be returned to the Seller. In this case, the contract will be considered terminated pursuant to art. 1456 of the Italian Civil Code, with communication from the Seller sent by email to the User and therefore the order will be cancelled.
The User always has the possibility to check the status of his order through the appropriate link by entering the number of his order or through his personal area in the event that he has previously registered on www.ldilinda.com
User Obligations
Minors are strictly prohibited from placing an order on the Site. The data entered during the purchase phase must be exclusively your own real personal data and not those of third parties, or fictitious. The Seller reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.
The User indemnifies the Seller from any liability arising from the issuance of incorrect tax documents due to errors in the data provided by the User, being the User himself solely responsible for the correct entry. Upon receipt of the products, the User is required to verify their conformity in relation to the order. In particular, he must pay attention to the correspondence between the number of packages indicated on the carrier's letter and those delivered and to the integrity of the packaging. Any anomalies (e.g. tampering, damage) must be specified in writing directly in the courier's transport document and the User must refuse delivery. At the same time, the User is required to report the fact to the Seller's Customer Service through the appropriate link. If the User accepts the delivery of tampered or damaged products, he will forfeit the legal guarantee of conformity of the products.
Responsibility
The Seller assumes no responsibility for disruptions attributable to force majeure such as, by way of example, accidents, explosions, fires, strikes, earthquakes and other events which prevent, in whole or in part, the execution of the contract within the agreed timeframes.
The Seller shall not be liable to any party or third party for damages, losses and costs incurred as a result of the failure to execute the contract for the reasons mentioned above, the customer being only entitled to the refund of the price paid.
Likewise, the Seller is not responsible for any fraudulent or illicit use that may be made by third parties of credit cards, checks and other means of payment, when paying for the products. In fact, the Seller, at no time during the purchase procedure is able to know the User's credit card number which, by opening a protected connection, is transmitted directly to the banking service manager.
Right of withdrawal
The User may exercise the right of withdrawal and return the product received, without any penalty and without specifying the reason, in compliance with the terms and conditions set out below.
The User can always make the return request directly online return form , by completing and forwarding the return request to the Seller within 14 days of delivery.
The products must be returned intact, undamaged and with the barcode and any other seal that is part of the products; products that are returned incomplete, ruined, damaged, deteriorated will not be refunded.
The Seller, in the event of exercising the right of withdrawal, has the right to not accept the return or not fully refund the sums paid for the purchase, in relation to those products which are not provided with the relevant guarantee tag (intended as a "security seal") or which have been altered in their essential and qualitative characteristics or which have been damaged.
The products to be returned must be delivered to the carrier within 14 days from the User's communication to the Seller of his/her intention to withdraw from the contract.
The costs of returning compliant products will be borne by the User. After the return of the products, the Seller will carry out the necessary checks relating to their conformity to the conditions and terms indicated therein.
If the right of withdrawal is correctly exercised, the Seller will refund any sums already received by the User for the purchase of the products, net of shipping costs.
Whatever the payment method used by the User, the refund is activated by the Seller as soon as possible and in any case within 14 days from the date on which the Seller became aware of the exercise of the right of withdrawal, after verifying the correct execution of the same and checking the returned products.
The Seller will refund using the same means of payment used by the User to purchase the returned products, even if a virtual and/or disposable credit card was used. The Seller will not be able to refund in any way to a credit card other than the one used for the purchase, except in the case where the card itself has expired in the meantime or has been stolen: in this case the User may send an email to info@ldilinda.com to agree on the most appropriate means of refund.
Guarantee of conformity
Pursuant to the law, the Seller is obliged to deliver to the User goods that comply with the sales contract and the Seller is liable for any lack of conformity of the products existing at the time of delivery or which become apparent within two years of delivery.
For the validity of the preceding guarantee, the User must report the lack of conformity to the Seller within two months of discovery, under penalty of forfeiture, by contacting Customer Service via a specific link. The report must contain an accurate and complete description of the contested defects and faults. Customer Service will provide the User with instructions for returning the defective product, which will be at the Seller's expense.
The User will have the right to request the termination of the contract and the refund of the amount paid or, alternatively, the replacement of the product. In the event of a minor defect/fault, the User will only have the right to the replacement of the product.
In any case, defects of conformity resulting from damage due to accidental events or from the User's responsibility for use not in accordance with the intended use of the product are excluded from the legal guarantee.
Applicable law
Any dispute relating to the application, execution, interpretation and violation of the sales contracts stipulated through the Site is subject to Italian law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. In any case, any rights attributed to the Consumer by mandatory provisions of law in force in the State of residence or domicile of the latter will be safeguarded.
Changes and updates
The Seller reserves the right to modify the Site, the policies and these General Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions. The User who accesses the Site and places an order will adhere to the policies and terms of the General Conditions of Sale in force from time to time at the time the order is placed, unless any changes have retroactive effect under applicable law. If one of the provisions herein is held to be invalid, void or inapplicable, such condition will not affect the validity and effectiveness of the other provisions.

Access to and use of the Site, including viewing web pages, communicating with the Manager, downloading product information and purchasing them on the website, constitute activities conducted by our users exclusively for personal use unrelated to any commercial, entrepreneurial or professional activity. The User is the sole and exclusive person responsible for the use of the Site and its contents. In fact, the Manager cannot be held responsible for any use of the website and its contents by any of its users that is not compliant with the laws in force, without prejudice to the Manager's liability for fraud and gross negligence. In particular, the user will be the sole and exclusive person responsible for communicating information and data that is incorrect, false or relating to third parties, without their express consent, as well as for any incorrect use of the same.
Finally, since all material will be downloaded or otherwise obtained through the use of the service at the user's choice and risk, any liability for any damage to computer systems or loss of data resulting from downloading operations falls on the user and cannot be attributed to the Manager. The Manager declines all liability for any damage resulting from the inaccessibility of the services on the Site or from any damage caused by viruses, damaged files, errors, omissions, interruptions of service, deletion of content, problems connected to the network, providers or telephone and/or telematic connections, unauthorized access, alteration of data, failure and/or defective functioning of the user's electronic equipment.
The user is responsible for the safekeeping and correct use of his/her personal information, including the credentials that allow access to reserved services, as well as for any damaging consequences or prejudice that may arise against the Manager or third parties as a result of the incorrect use, loss or theft of such information.
Intellectual Property Rights
The contents of the Site, such as, by way of example, the works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format, published on the Site, including the menus, web pages, graphics, colors, schemes, tools, characters and design of the website, diagrams, layouts, methods, processes, functions and software that are part of the Site (collectively the “Contents”), are protected by copyright and any other intellectual property right of Milor SpA – and/or the Manager and other rights holders. The reproduction, in whole or in part, in any form, of the Site and/or its Contents is prohibited without the express written consent of the Manager.
The Manager has the exclusive right to authorize or prohibit the direct or indirect, temporary or permanent reproduction, in any way or form, in whole or in part, of the Site and its Contents.
With regard to the use of the Site, the user is only authorized to view the Site and its Contents. Furthermore, the user is authorized to perform all those other temporary reproduction acts, devoid of their own economic significance, which are considered transitory or accessory, an integral and essential part of the same viewing of the Site and its Contents and all other navigation operations on the website that are performed only for a legitimate use of the Site and its contents. The user is not authorized to perform any reproduction, on any medium, in whole or in part of the Site and its Contents.
Any act of reproduction must be, from time to time, authorized by the Manager or, if necessary, by the authors of the individual works contained in the Site. Such reproduction operations must in any case be carried out for lawful purposes and in compliance with the copyright and other intellectual property rights of the manager and the authors of the individual works contained in the Site. However, the Manager does not assume any responsibility towards users for the accuracy and completeness of the contents published on the Site, without prejudice to its liability for fraud and gross negligence and except as otherwise provided by law. Trade policy
These Conditions for the exercise of the right of withdrawal, forming an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code, Chapter I "Consumer rights in contracts".
